General Terms & Conditions

Users may not redistribute Content (such as tutorials, eBooks, videos, courses, and source files) or any project files, spreadsheets or other assets associated with content included to demonstrate the course or tutorial. The user may use the files for their own personal education purposes, but must not otherwise exploit the files and the assets in them.

The trademarks and logos displayed on the site are, unless otherwise stated, those of Dolphin Academy and you must not use these without the approval of the relevant owner.

Fair use and Prohibited Conduct

Users, both members as well as non-members, are permitted to download specific content to their computers if subject to a ‘fair use’ policy. Our ‘fair use’ policy requires that the use of the site and the content must be fair, genuine and reasonable. We will use our reasonable discretion to decide whether a user has complied with the ‘fair use’ policy.

Violation of the ‘fair use’ policy includes:

·         Using scripts to automatically mass download content

·         Use a false email address, impersonate others or misrepresent your affiliation with others

·         Insert advertising, branding or other promotional content into the site or content

·         Attempt to gain unauthorized access to computer systems or materials through the site

·         Engage in automatic gathering of information from or through the site (such as “spidering”, “screen scraping”, “database scraping”, or harvesting of e-mail addresses)

·         Attempt to interrupt or alter the site’s operation in any way (for example through sending mass unsolicited messages, “flooding” servers, or introducing a virus, time bomb, Trojan horse, worm, cancelbot or other computer routine

·         Use the site or the content in a way that violates applicable law, that violates the third party intellectual property or other rights, or that is, fraudulent, obscene, offensive, or defamatory

·         Except as allowed in the Membership Terms & Conditions; copy, distribute, transmit, modify or otherwise, exploit the content or any other data or code made available through the site. 

Disclaimer

The site will usually be available 24 hours a day, seven days a week. We may, however, need to interrupt or suspend your access to the site or the provision of the site’s services and content, for maintenance, technical or other reasons. Although we strive to make the site as accessible as possible, the range of assistive technology today is so wide and varied, that the user may encounter some issues depending on the assistive technology. We appreciate your understanding.

When accessing and using the site and its services and content, you must comply with directions, instructions or protocols posted on the site. 

We are pleased to be able to offer a wide range of exclusive content on the site for your educational and learning needs, which we aim to regularly add too. The content will be updated, changed or removed from time to time, at our discretion, so we can’t guarantee that specific content will always be available on the site.

Membership Terms & Conditions Membership Plan

After purchasing a monthly or yearly membership plan, the member automatically understands and agrees that he/she has committed to a contract.

This contract includes the following:

·         The membership is only available for purchase by individuals that are 18 years old or older.

·         The memberships are non-transferable. Members must not share their username and password with anyone else or allow anyone else to access the site using their username and/or password. 

·         The member is responsible for every use of the site that occurs in conjunction with use of their username and password. He/she must use reasonable efforts to keep your username and password confidential. Both members, as well as non members, must notify us as soon as they become aware of any unauthorized use of the membership, username, or password.

·         The membership is a right (revocable license) to use the content for personal purposes. Members may not redistribute content (such as tutorials, eBooks, videos, courses, and source files). Any project files, spreadsheets or other assets associated with the content are included to demonstrate the course or tutorial. The member may use the files for their own personal education purposes, but must not otherwise exploit the files and the assets in them, or redistribute the files or assets.

The contract also automatically includes the agreement that the membership fees are payable by the member at the rate offered at purchase time and automatically renewed every month until the member unsubscribes. 

Membership Renewal Policy

Dolphin Academy will automatically renew your memberships every month. During the renewal process each month or year, members must attest to continued eligibility for membership. 

If you do not wish to renew your membership, you are required to give us a written notice by email of at least one month before the date on which your current membership expires (contact details below). 

Refusal, Suspension or Cancellation of Membership

Dolphin Academy reserves the right to refuse/cancel a membership and access to the site, including if the user violates or neglects any of the Membership Terms, any other site rules, or applicable law.

PLEASE REVIEW YOUR ORDER CAREFULLY.
Cancellations received after a Membership order is submitted are automatically not eligible for a refund. 

Cancellations of Dolphin Academy membership plans will only be accepted via e-mail [online@dolphin-academy.com] or via your My Account.  

In addition, all benefits and incentives received by the participant will be canceled/returned to Dolphin Academy at the end of the payed subscription period. 

The above policies apply to all Dolphin Academy Memberships unless otherwise noted in the corresponding program materials. Please read all the individual program information thoroughly.

Changes to Membership Terms

We may change the membership terms from time to time, but we will notify members before doing so. The member will then be given the opportunity to cancel their subscription with a pro-rata refund (based on time remaining of the membership and the applicable terms of notice) if the member does not want to accept the changes. If the member doesn’t opt-out in this way, the membership is continued and the use of the site will be an acceptance of the updated membership terms. 

Additional Terms & Conditions

Azure Blue Membership

The 50% discount on one of our Dolphin Experiences is valid for 1 person, once in a year, as long as the membership is active. The experience must be booked through online@dolphin-academy.com . As the care of the dolphins is the foremost priority of Dolphin Academy, all experiences can be canceled/moved if necessary. 

Be aware that the free beach towel is only available for those that purchase a yearly Azure Blue Membership and thus pay the yearly membership fee at once. 

Please take into account that all of our products are shipped from our facility on Curaçao, Netherlands Antilles, and can take up to 30 days to reach their destination once they are processed. This also counts for the free beach towel.


Navy Blue Membership

The 50% discount on one of our Dolphin Experiences is valid for 1 person, once in a year, as long as the membership is active. The experience must be booked through online@dolphin-academy.com . As the care of the dolphins is the foremost priority of Dolphin Academy, all experiences can be canceled/moved if necessary. 

Be aware that the Exclusive VIP Dolphin Experience is only available for those that purchase a yearly Navy Blue Membership and thus pay the yearly fee at once. This Dolphin Experience must be booked within 2 years of date of purchase and must be booked through online@dolphin-academy.com .
